Issues

  • In 2005 RBC entered into an agreement with United Utilities regarding the collection of water charges. Subsequently, a number of variations were made to the Tenancy Agreement to reflect the extent to which water charges were perceived to form part of the rent.

Approach

  • RBH LSET provided advice on the legality of these changes, drawing both on its legal expertise and its practical knowledge of the issues involved. This advice was subsequently tested in court, during a contested Claim for Possession.

Outcomes

  •  RBH LSET constructed a robust argument on the legality of the charges, and the defendant's appeal was withdrawn.
  • Through this work, RBH LSET has become involved with RBH's Water Charges Scrutiny Group, providing it with further available insight on the practical issues involved in this complex and sensitive area of operations.
