Issues

  • Tenancy problems included refusing to allow access by boarding up all the doors and windows, damaging property, assaulting staff, posting derogatory comments about staff on a dedicated web page and sending hundreds of faxes in order to disrupt services.

Approach

  • Discussion with partner agencies confirmed a complex case, with mental health problems a complicating factor and while the police were considering criminal proceedings there was reluctance by agencies to take an approach which would place the tenant in the prison system.
  • RBH LSET contacted other agencies and housing providers who the tenant had previously targeted in a similar way. This research showed a previous private injunction on behalf of an MP that had resulted in a custodial sentence. Details obtained were used as evidence in the proceedings issues by RBH LSET.
  • Detailed evidence was assembled by RBH LSET to demonstrate a long term pattern of behaviour that the tenant was incapable of changing.
  • Following Court proceedings RBH LSET successfully serve the injunction, despite attempts to evade this by the tenant.
  • RBH LSET provided the solicitors representing the tenant for disrepair with detailed evidence that disrepair was due to the tenants own actions.

Outcomes

  • The tenants solicitors agreed not to pursue the disrepair case.
  • A 14 day possession order was granted. The tenant left the property.
  •  A successful injunction was served - with no further malicious web postings
  • The property, together with the flat above which had also been badly affected by disrepair, was converted into a family home.
